PUBLIC NOTICE TO ALL USERS OF COPYRIGHT AND RELATED RIGHTS IN MUSICAL AND DRAMATIC WORKS.

NOTICE IS HEREBY given to the general public involved in BROADCASTING, COMMUNICATION TO THE PUBLIC, PERFORMANCE IN PUBLIC PLACES and MECHANICAL REPRODUCTION of copyrighted works THAT:-

1) KENYA ASSOCIATION OF MUSIC PRODUCERS (KAMP) – Administering and Managing Economic Rights of Producers of Sound Recording and Audio visual Works;

2) PERFORMERS RIGHTS SOCIETY OF KENYA (PRISK) – Administering and Managing Economic Rights of Performers in Sound Recordings and Audio-visual works; and 

3) MUSIC COPYRIGHT SOCIETY OF KENYA (MCSK) – Administering and Managing Economic Rights of Authors, Composers, Arrangers and Publishers of musical works.

KAMP, PRISK and MCSK have been licensed as Collective Management Organizations (CMO) as per the provisions of Section 46 of The Copyright Act, 2001, Laws of Kenya to issue a JOINT COPYRIGHT LICENSE.

TAKE NOTE THAT:

1)      EFFECTIVE 17^th June 2019, pursuant to Special Issue of Kenya Gazette Supplement Legal Notice No. 107 The Attorney General has approved and GAZETTED the JOINT COLLECTION TARIFFS. KAMP, PRISK and MCSK in JOINT LICENSING OPERATIONS shall be using the JOINT COLLECTION TARIFF in calculating/ assessing JOINT LICENSE FEES payable in the exploitation of Broadcast, Communication to the Public, Performance in Public Places, Synchronization and Mechanical Reproduction Economic Rights.

2)      Users are entitled to receive ANNUALLY a JOINT COPYRIGHT INVOICE from the CMOs which should be paid within THIRTY (30) DAYS OF ISSUE. If a user neglects, refuses and/or fails to pay the license fee within the stipulated one month period, there is a NON-COMPLIANCE PENALTY OF 5% COMPOUNDED MONTHLY of invoice amount shall be payable for the period it remains unpaid.

3)      We advise all users of Copyrighted Musical and audio visual works to pay for the Joint Copyright License either through MPESA, CHEQUE, OR DIRECT CREDITS into the Joint account provided below.
