The Media Owners Association (MOA) signed a joint licensing Memorandum of Understanding (MoU) with the three Collective Management Organisations (CMOs) – Kenya Association of Music Producers (KAMP) representing producers, Performers Rights Society of Kenya (PRISK) representing performers and Music Publishers Association of Kenya (MPAKE) representing authors, composers, arrangers and publishers that now paves way for the remittance of the Communication to the Public license fees by TV and Radio stations in Kenya. It has set guidelines on how payments will be made and how logs of works used will be exchanged.
The deal follows several months of negotiations that were spearheaded by the Kenya Copyright Board (KECOBO) which is the regulator for CMOs and custodian of the Copyright Act in Kenya. It further, brings to life the dream of joint licensing where users of sound recordings and audio-visual works will be issued with a single license by the three CMOs.
Media plays a critical role in exploitation of musical and audio-visual works. The one-year agreement, effective from 1st July 2017- July 2018, will now ensure that artistes are rightfully remunerated for the use of their works by broadcasting stations in the country. Media houses present include: Nation Media Group, Standard Group, Royal Media Services Ltd, and Radio Africa Group.
Also present were media stakeholders including Ms. Lynette Mwangi, CEO Media Owners Association, Mr. Ian Fernandes, CEO Mediamax, Mr. Clifford Machoka Head of Corporate & Regulatory Affairs at Nation Media Group, and Mr. Njogu Njehia of Royal Media Services Ltd. CMO representatives included: Mr. Justus Ngemu, Chairman of Kenya Association of Music Producers, Mr Clifford Mabele, Chief Executive Officer of Kenya Association of Music Producers, Ms. Beatrice ‘Iddi’ Achieng, Chairperson of Performance Rights Society of Kenya, Mr. Bernard Kioko, Chairman of Music Publishers Association of Kenya, and Mr. Hubert ‘Nonini’ Nakitare, PRISK’s Director.
